New Mexico State Fair Bans Dispensary from Show Anything Marijuana-Related

New Mexico Top Organics, a state-licensed dispensary, paid a $50 application fee to have an educational booth at this year’s New Mexico State Fair. But the State Fair Commission has decided to ban them from showing anything marijuana-related.

The restriction includes banners, flyers or clothing about marijuana, Courthouse News reports. Essentially, anything related to using, growing, processing or selling marijuana cannot be displayed.

Due to these restrictions and the inability to actually provide educational material, Top Organics won’t have its booth at this year’s state fair. They’ll be consumed in a legal battle instead.

The lawsuit names Larry Kennedy, Dan Mourning and Raina Bingham as the main defendants in the case.

At last year’s state fair they had a booth with a 3-week old marijuana plant. On the first day of the fair, the police forced “Dorothy” (the plant) to leave the event.

Top Organics is making its claims based upon violations of the 1st and 14th Constitutional Amendments along with damages and attorney’s fees.
